Terms for using the Intellektus website and online order forms.

1. Parties

These Terms govern the use of the Intellektus website and the order of trademark services from Intellektus [TODO: full legal entity name], registered at [TODO: registered office address], [TODO: company number], VAT [TODO: VAT number] ("we", "us", "Intellektus"). By submitting an order or contact form you accept these Terms.

2. The service

Intellektus offers trademark search, registration, renewal and watching services in selected jurisdictions. Submitting a form starts a request. We confirm scope, fees and any conditions in writing before we file or take any official step on your behalf. Submitting a form or paying online does not in itself file a trademark application or complete a service.

3. Pricing and taxes

Prices are shown in EUR. Where indicated, prices include the official fee charged by the trademark office and our service fee; otherwise, official fees and class-count uplifts are added at checkout. VAT is included where applicable for EU private individuals and EU companies without a valid VAT number; B2B EU clients with a valid VAT number are billed under the reverse-charge rules.

4. Payment

Payable orders are completed through hosted checkout (Stripe or PayPal). A successful payment is the trigger to start work; it is not a guarantee that an official trademark office will accept, renew or register a mark. If a payment is later disputed or charged back, we may pause the work and contact you to resolve the matter.

5. Right of withdrawal — EU consumers

If you are a consumer based in the European Union, you have a 14-day right of withdrawal under Directive 2011/83/EU (Consumer Rights Directive).

However, by paying for and asking us to begin work immediately, you expressly request that the service starts during the withdrawal period and acknowledge that, once the service has been fully performed, you lose your right of withdrawal under Article 16(a) of the Directive. If we have begun but not yet fully performed the service when you withdraw, you will pay us a proportionate amount for the work already completed.

If you are a business client (B2B), the statutory consumer right of withdrawal does not apply; cancellation is governed by section 6 below.

6. Cancellation and refunds

You can cancel an order at any time before we file with an official office. After filing, fees paid to the office are non-refundable; our service fee is refundable only to the extent the work has not been performed. Refunds are issued back to the original payment method within 14 days.

7. Your obligations

You confirm that the information and documents you provide are accurate and that you are entitled to provide them, including any rights in logos and other uploaded files. You will respond to reasonable requests for clarification within the deadlines we agree.

8. No legal advice / no outcome guarantee

The website provides general information. Nothing on the website is legal advice. Trademark availability, registrability and enforceability depend on facts and law applied by trademark offices, courts and competent authorities; we do not guarantee any outcome.

9. Liability

Subject to mandatory law, our aggregate liability for any matter is limited to the fees you paid us for that matter. We are not liable for indirect or consequential losses (loss of profit, loss of goodwill, business interruption). Nothing in these Terms limits our liability for fraud, gross negligence, wilful misconduct or anything else that cannot lawfully be excluded.

10. Intellectual property of the site

The Intellektus website, its content, layout and design are protected by intellectual property rights. You may use the site for its intended purpose; you may not scrape, reproduce, or use the site for automated data extraction.

11. Privacy

Personal data processed in connection with the website and our services is handled in line with the Privacy Policy.

12. Governing law and disputes

These Terms are governed by the laws of [TODO: governing law jurisdiction, e.g. The Netherlands]. The courts of [TODO: forum, e.g. Amsterdam, The Netherlands] have exclusive jurisdiction, except that consumers may bring proceedings in the courts of their place of habitual residence as required by mandatory consumer law. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

13. Changes

We may update these Terms. The version that applies to your order is the one in force on the date you submit the order; we will notify you of any change that materially affects your rights for ongoing engagements.
